1. Introduction

Pursuant to Article 13 of the Swiss Federal Constitution and the federal data protection provisions (Federal Act on Data Protection, FADP), every person has the right to protection of their privacy and to protection against misuse of their personal data. The operators of this website take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the applicable data protection legislation and this Privacy Policy.

In cooperation with our hosting providers, we make every effort to protect our databases as effectively as possible against unauthorised access, loss, misuse or falsification. Please note that data transmission over the Internet (e.g. communication by email) may be subject to security vulnerabilities. Complete protection of data against access by third parties cannot be guaranteed.

By using this website, you consent to the collection, processing and use of data as described below. In principle, this website can be visited without registration. Data such as pages accessed or names of files accessed, as well as the date and time of access, may be stored on the server for statistical purposes without this data being directly associated with you personally. Where personal data (for example names, addresses or email addresses) is collected on our website, this is done, wherever possible, on a voluntary basis. This data will not be disclosed to third parties without your explicit consent.

2. Processing of Personal Data

Personal data is any information relating to an identified or identifiable person. A data subject is a person whose personal data is processed. Processing includes any operation performed on personal data, regardless of the means and procedures used, in particular the storage, disclosure, collection, deletion, retention, alteration, destruction and use of personal data.

We process personal data in accordance with Swiss data protection law. Where and insofar as the EU General Data Protection Regulation (GDPR) applies, we additionally process personal data on the following legal bases in accordance with Article 6(1) GDPR:

a) Processing of personal data with the consent of the data subject.
b) Processing of personal data for the performance of a contract with the data subject and for taking appropriate steps prior to entering into a contract.
c) Processing of personal data for compliance with a legal obligation to which we are subject under applicable EU law or the applicable law of a country in which the GDPR applies in whole or in part.
d) Processing of personal data in order to protect the vital interests of the data subject or another natural person.
f) Processing of personal data for the purposes of our legitimate interests or those of a third party, except where such interests are overridden by the fundamental rights, freedoms and interests of the data subject.

Our legitimate interests include, in particular, our business interest in being able to provide our website, ensuring information security, enforcing our own legal claims and complying with Swiss law. We process personal data for as long as is necessary for the respective purpose or purposes. Where longer retention periods apply due to statutory or other obligations to which we are subject, we restrict processing accordingly.

3. Transfer of Data Abroad

We do not transfer data abroad.

4. Cookies

This website uses cookies. Cookies are small text files that make it possible to store specific information relating to the user on the user's device while the user is using the website. Cookies make it possible, in particular, to determine the frequency of use and number of users of the website, analyse patterns of website usage and make our services more user-friendly. Cookies may remain stored after the end of a browser session and can be accessed again when you revisit the website. If you do not want this to happen, you should configure your Internet browser to refuse cookies.

5. SSL/TLS Encryption

For security reasons and to protect the transmission of confidential content, such as inquiries you send to us as the website operator, this website uses SSL/TLS encryption. You can recognise an encrypted connection by the fact that the browser's address bar changes from "http://" to "https://" and by the padlock symbol displayed in your browser. When SSL or TLS encryption is enabled, the data you transmit to us cannot be read by third parties.

6. Server Log Files

In order to provide its services reliably, correctly from a technical perspective and in compliance with applicable legislation, the servers of our hosting provider create so-called log files. These contain information such as:

IP addresses
Date and time
Protocol information such as protocol type and version
The requested action, status codes or information about transferred data (e.g. the size of a request or response)
Error messages

Depending on the application, additional information may also be stored, such as message IDs for emails or, in the case of website access, information about the browser used (user-agent string) and, where applicable, the website from which the visitor reached our website. This applies not only to interactions with websites but to all our services, including, for example, email (SMTP, POP, IMAP), FTP, SSH, etc. We use this information, among other things, to identify and resolve technical problems, detect user errors, defend our infrastructure against attacks, support post-mortem analyses of compromised customer websites and compile visitor statistics for websites.

The data remains on our systems until it is no longer required for operational purposes and the applicable statutory or contractual retention periods have expired. It is then automatically deleted. For most data, the maximum retention period is six months. This data cannot be attributed to specific individuals. This data is not combined with data from other sources. We reserve the right to review this data retrospectively if we become aware of specific indications of unlawful use.

7. Contact Form

If you send us an inquiry using our contact form or submit an enrollment inquiry for our school, the information you provide in the inquiry form, including the contact details you enter there, will be stored by us for the purpose of processing your inquiry and in case of follow-up questions. We will not disclose this data without your consent.

8. Your Rights

8.1 Right to Confirmation

Every data subject has the right to request confirmation from the operator of this website as to whether personal data concerning them is being processed. If you wish to exercise this right to confirmation, you may contact us at any time by email at schule@montessori-zuerich.ch.

8.2 Right of Access

Every person affected by the processing of personal data has the right to obtain from the operator of this website, free of charge and at any time, information about the personal data stored concerning them and to receive a copy of this information. Where applicable, information may also be provided about the following:

The purposes of the processing
The categories of personal data being processed
The recipients to whom the personal data has been or will be disclosed
Where possible, the envisaged period for which the personal data will be stored or, if this is not possible, the criteria used to determine that period
The existence of a right to request rectification or erasure of personal data, restriction of processing by the controller, or the right to object to such processing
The existence of a right to lodge a complaint with a supervisory authority
Where the personal data was not collected from the data subject, any available information as to its source

In addition, the data subject has the right to be informed whether personal data has been transferred to a third country or to an international organisation. Where this is the case, the data subject also has the right to be informed of the appropriate safeguards relating to the transfer. 8.3 Right to Rectification

Every person affected by the processing of personal data has the right to request the immediate rectification of inaccurate personal data concerning them. 8.4 Right to Erasure

Every person affected by the processing of personal data has the right to request that the controller of this website erase personal data concerning them without undue delay where one of the following grounds applies and the processing is no longer necessary:

The personal data was collected or otherwise processed for purposes for which it is no longer necessary.
The data subject withdraws the consent on which the processing was based and there is no other legal basis for the processing.
The data subject objects to the processing on grounds relating to their particular situation and there are no overriding legitimate grounds for the processing, or the data subject objects to processing for direct marketing purposes, including related profiling.
The personal data has been processed unlawfully.
The personal data must be erased in order to comply with a legal obligation under European Union law or the law of a Member State to which the controller is subject.
The personal data was collected in relation to information society services offered directly to a child.

8.5 Right to Restriction of Processing

Every person affected by the processing of personal data has the right to request that the controller of this website restrict the processing of their personal data where one of the following conditions applies:

The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data.
The processing is unlawful and the data subject opposes the erasure of the personal data and requests instead that its use be restricted.
The controller no longer requires the personal data for the purposes of processing, but the data subject requires it for the establishment, exercise or defence of legal claims.
The data subject has objected to the processing on grounds relating to their particular situation and it has not yet been determined whether the legitimate interests of the controller override those of the data subject.

8.6 Right to Data Portability

Every person affected by the processing of personal data has the right to receive the personal data concerning them in a structured, commonly used and machine-readable format. The data subject also has the right to have personal data transmitted directly from one controller to another, where technically feasible and provided that doing so does not adversely affect the rights and freedoms of others. 8.7 Right to Object

Every person affected by the processing of personal data has the right to object at any time, on grounds relating to their particular situation, to the processing of personal data concerning them. In the event of an objection, the operator of this website will no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or where the processing is necessary for the establishment, exercise or defence of legal claims. 9. Google reCAPTCHA

To protect our forms against abusive automated use and spam, we use Google reCAPTCHA. The provider is Google. reCAPTCHA analyses whether an entry is made by a natural person or by an automated system. In doing so, technical information such as the IP address, browser and device information, as well as cookies, may be processed.
